Sportscar World Rentals – Track and Drive Day Experiences

By purchasing a gift-voucher or making a reservation with Sportscar World Renatals for a Drive-Experience or Track
event, you acknowledge that you have read and agree to be bound by these Terms and Conditions.

1. Drive Day Experiences provided by Sportscar World Rentals
1.1. Sportscar World Rentals reserves the right to add, withdraw, substitute and/or vary advertised routes, prices,
and departure time (‘Arrangements’) for a Track and or Drive Day Experience or Gift Voucher, without notice.
However reasonable is always made to maintain Arrangements as advertised.

2. Requirements to Participate
2.1. Eligible Drivers must be at least 25 years of age and in possession of a valid full driver’s licence which they
must have held for a minimum period of 3 years overall. The Participant authorises Sportscar World Rentals if
necessary, to make enquiries with the local traffic authority in relation to the validity of the Participant’s licence.
2.2. All Participants should be in good health and be of sound mind.
2.3. All Participants must hold a valid Proof of ID and must be able to show proof of their identity, excluding
passengers under the age of 18 years.
2.4. Any Passengers must be a minimum age of 13 years.
2.5. All Participants will be required to sign a Participant Declaration and Disclaimer Form. The Form includes but is
not limited to statements that the Participant has read and understood Sportscar World Rentals health and
safety information, which sets out, among other things, the conditions under which the Participant should not
participate in a Drive. Participants enter Sportscar World Rental premises and or Event Locations and
participate at their own risk.
2.6. All participants ('Drivers and Passengers') in a Drive-Day or Track Event are required to arrive at Sportscar
World Rentals at 69 Victoria road, Drummoyne NSW 2047 or Event location as specified on participants
booking or voucher no later than 30 minutes after the scheduled departure time printed on their notification,
voucher, or confirmation letter. Sportscar World Rentals may at its discretion refuse participation if the
participants are more than 30 minutes late, without refund should this arise.
2.7. Sportscar World Rentals reserves the right to perform a breath test on all Participants. Participants will be
refused participation in a Track or Drive Day Experience, without refund if their blood alcohol concentration is
NOT 0.00%, if they refuse to be breath-tested or if they are under the influence of drugs (legal or illegal).
2.8. There is no more than one passenger in car with Instructor at any track events. Hot laps included.

3. Refusal of Participation
3.1. Sportscar World reserves the right to refuse any person, for whatever reason, participation in a Track or Drive
Day Experience at their discretion, whether or not that person has already purchased a Track or Drive Day
Experience.

4. Insurance Excess
4.1. Drive Day Insurance is provided for each Participant on the provision that they agree to pay a maximum 'AT-
FAULT' insurance excess of $12,000 (twelve thousand dollars) a $2000 dollar (two thousand dollar) pre
authorisation will be taken at the time of the Experiences which is held for the day. In the event of an accident
or any damage caused directly or indirectly by the participant or any of their guests the $2000 dollars will be

part payment of the $12000 excess payable to Sportscar World Rentals where it is deemed by the traffic
authorities or by Sportscar that the Participant is at fault.
4.2. Track Experience Insurance is provided for each Participant on the provision that they agree to pay a maximum
'AT-FAULT' insurance excess of $12,000 (twelve thousand dollars) a $2000 dollar (two thousand dollar) pre
authorisation will be taken at the time of the Experiences which is held for the day. In the event of an accident
or any damage caused directly or indirectly by the participant or any of their guests the $2000 dollars will be
part payment of the $12000 excess payable to Sportscar World Rentals where it is deemed by the traffic
authorities, Event organisers/staff or by Sportscar World Rentals staff that the Participant is at fault.
4.3. If the cost of the repair is deemed to be less than the excess by Sportscar World Rentals, then the participant
will be charged the repair cost.
4.4. A pre authorisation on credit card is required of $2000 for Drive Days and $2000 for Track Day events as
mentioned above in point 4.1 and 4.2

5. During the Drive Day
5.1. All Participants must obey the directions and instructions of Sportscar World Rentals Tour Leader, must not
disturb other Participants or interfere with the Tour Leader's ability to conduct the Drive Day in a safe and
secure manner, and must not damage, deface or remove any part of the vehicles or any equipment supplied for
the Drive day.
5.2. All Participants agree to obey and abide by road rules as this is a non-competitive event and agree not to drive
any vehicle in a manner deemed unsafe, dangerous or negligent.
5.3. Smoking is not permitted in any vehicle at any time - $500.00 detailing fee applies.
5.4. Sportscar World Rentals retains the right to remove from a Drive Day any participant who does not comply with
these Terms, without Refund.

6. Terms of Payment
6.1. All Track and Drive Day Experience bookings and gift-vouchers are a non-refundable purchase but may be
transferrable to another Participant subject to all terms and conditions and eligibility criteria.
6.2. Drive Day, Gift Vouchers and Gift Certificates, and rights or entitlements to Drive-Experiences, Gift Vouchers
and Gift Certificates or to purchase Drive-Experiences, Gift Vouchers and Gift Certificates, must not be offered
as prizes, offered for sale or resale, or resold or used for any commercial purpose (including, without limitation,
promotion of any supplier or any supplier's products or services) without Sportscar World Rentals prior written
consent. If Sportscar World Rentals reasonably believes that any other activities have occurred without such
consent, the holder of the reservation, Gift Voucher or Gift Certificate may be refused participation in a Track or
Drive Day Experience, without payment or any compensation whatsoever.
6.3. All Track and Drive Day Experiences must be paid for at the time of making the reservation unless otherwise
agreed by Sportscar World Rentals in advance. Sportscar World Rentals reserves the right to charge fees on
the purchase of Track and Drive Day Experiences, on changes to reservations and on Gift Vouchers or Gift
Certificates purchased.

7. Terms of Postponement and Cancellation
7.1. Track and Drive Day Experiences will not proceed should Sportscar World Rentals decide in its absolute
discretion, whether for safety reasons or otherwise, to cancel a Track and Drive Day Experience.
7.2. Should a Track and Drive Day Experience not proceed, Participants will be re-scheduled at their convenience,
or issued with an open-dated Gift-Voucher that is valid for an additional 12 months.
7.3. Sportscar World Rentals reserves the right to cancel or postpone any Track or Drive Day Experience without
notice and may not be held responsible for the incurrence of any associated costs or 'Out of Pocket' expenses
resulting from postponement or cancellation of any Drive-Experience.

7.4. Participants may postpone their Track and Drive Day Experience to a later date provided they contact Sportscar
World Rentals at least FOUR (4) weeks prior to their scheduled Track or Drive Day Experience Re-Schedule
fees as follow:
 1 – 4 weeks prior to pick-up: 20% of total charge
 Within 2-6 days: 50% of total charge
 Within 24 Hours or No-Show: 100% of total charge
7.5. Reduction in the number of Participants is not permitted.

8. Miscellaneous Conditions
8.1. Photographs and Video purchased from or supplied by Sportscar World Rentals remain copyright to Sportscar
World Rentals, and may only be used or reproduced by the purchaser or recipient for private or domestic
purposes, and must not be used for any commercial purpose (including promotion of any supplier or any
supplier's products or services) without Sportscar World Rentals prior written permission.
8.2. Sportscar World Rentals has the authority to use and reproduce any photograph or video taken of Participants
for any purpose, without prior notice or payment of compensation to Participant.
8.3. Sportscar World Rentals reserves the right to inspect any bag or container brought onto Sportscar World
Rentals premises or brought onto any event premises where a Track and Drive Day Experience is being held.

9. Sportscar World Rentals Liability
9.1. Nothing in these Terms excludes, restricts or modifies any condition, warranty, right or remedy, implied or
imposed by any statute or regulation that cannot lawfully be excluded, restricted or modified, which may include
Part V of the Trade Practices Act 1974 (Cth) and corresponding provisions of State or Territory legislation
containing implied terms and warranties that operate to protect the purchasers of goods and services in various
circumstances. Subject to the last sentence, all express or implied representations, conditions, warranties and
provisions, whether based in statute, common law or otherwise, relating to provision of products and services
pursuant to or as contemplated by these Terms that are not contained in these Terms, are excluded to the
extent permitted by law.
9.2. If any condition or warranty is implied into these Terms under the Trade Practices Act 1974 (Cth) or any
equivalent State or Territory legislation and cannot be excluded, and Sportscar World Rentals is able to limit
remedy for a breach of such a condition or warranty, the liability of Sportscar World Rentals for breach of that
condition or warranty is limited, at Sportscar World Rentals absolute discretion, to one or more of the following:
in the case of products, to replace the products, supply equivalent products or repair the products, to pay the
cost of replacing the products or of acquiring equivalent products, or to pay the cost of having the goods
repaired; and in the case of services, to supply the services again or to pay the cost of having the services
supplied again. This clause 9.2 is subject to clause 9.3.
9.3. Section 68B of the Trade Practices Act 1974 (Cth) in certain circumstances permits a term of a contract for the
supply by a corporation of recreational services to limit liability of the supplier pursuant to section 74 of that Act
for death or personal injury relating to that supply. To the extent permitted by section 68B, Sportscar World
Rentals limits its liability for death or personal injury relating to the supply of recreational services to A$100,000
per occurrence.
9.4. Subject to clauses 9.1, 9.2 and 9.3 and to the extent permitted by law, Sportscar World Rentals excludes
liability and will not be responsible for loss or damage arising from: Participants failure to obey Sportscar World
Rentals safety directions or instructions; any pre-existing medical or psychological condition; any negligent act
or omission of Sportscar World Rentals or any person for whom Sportscar World Rentals is responsible; any
delay in a scheduled Track or Drive Day Experience taking place; and any loss of or damage to vehicles,
valuables or luggage placed at Sportscar World Rentals premises.

9.5. Subject to clauses 9.1, 9.2, 9.3 and 9.4, and to the extent permitted by law, the Participant releases and
discharges Sportscar World Rentals from any claim, action, demand or proceeding (including those arising from
negligence, to the extent permitted by law) relating to or arising from participation in a Track or Drive-
Experience.

10. Resellers
10.1 When Reseller enters into a sale, reservation or any other transaction, the Reseller shall indemnify Sportscar
World Rentals for any loss, damage or expense incurred by Sportscar World Rentals as a result of any
misrepresentation, breach of contract by or act of negligence of the Reseller.

11. Gift Vouchers and Gift Certificates
11.1 Gift Vouchers and Gift Certificates are non-refundable, but are transferable.
11.2 Sportscar reserves the right to discontinue any product that may be acquired with a valid Gift Voucher or Gift
Certificate, but agrees to substitute the discontinued product with any other item to the same value.
11.3 A Gift Certificate must be redeemed within 12 months of the date of purchase.

These Terms are governed by the laws of New South Wales, Australia. Sportscar and each purchaser and Participant
submit to the non-exclusive jurisdiction of the Courts of New South Wales in respect of these Terms and any dispute
between them.

The Sportscar World Rentals website, its content (including text and images) and associated material on the site
available for download, is owned and copyrighted to Sportscar.

Please read and sign this form carefully

1. Drive Days only - Due to unforeseen circumstances some of the vehicles on this list may not be available.
Sportscar World Rentals will make available a minimum of 4 cars on any given Drive Day. Although all of our
cars are available 95% of the time, I acknowledge due to such things as servicing any one car may not be
there on the day.
2. Deposits are non refundable unless the event is cancelled by Sportscar World Rentals due to extreme bad
weather or road, track or Event closures. In this case Sportscar World Rentals will only be liable to refund the
deposit taken. In addition to this Sportscar World Rentals will not be responsible for any ancillary costs such
as air fares , accommodation or any other expense that may be suggested due to the cancellation of the event
3. All drivers must hold a current Drivers license at the time of the event. If a customer is found to have a
cancelled or suspended license you will not be permitted to drive and Sportscar World Rentals will not refund
any amount paid.
4. All drivers must abide by all terms and conditions of the as set out in the Driver Briefing before the Track or
Drive Day Experience day commences.

5. Sportscar World Rentals reserves the right to withhold any bond amount should it be deemed by the host of
the day that any of the following breaches have occurred:

- Excessive speeding (Drive Day on public road)

- Reckless driving

- Deliberately not following designated route (Drive Day)

- Damage to car due to Terms and Conditions as above

6. Sportscar World Rentals reserves the right on a Drive Day on public road to also withhold the $2000 (two
thousand dollars) should a driver be caught speeding excessively and the driver will forfeit their privilege of
driving any further on the day.
